InfoVista operates worldwide with its European headquarters located in Les Ulis, France and its North American headquarters located in Herndon, Virginia, USA. InfoVista is the world’s leading performance management software company which provides solutions and services for the effective management of Information Technology infrastructure. In order to better serve our customers and employees, customer information is from time to time transferred among InfoVista’s constituent organizations for processing.
Personal Information is generally any information about an identifiable individual. The type of Personal Information InfoVista collects, uses and discloses may include a name, mailing address, email address, various phone numbers, identification numbers, registration information, survey information, emails and telephone inquiries.
Collecting of Personal Information
We will always collect your Personal Information by fair and lawful means by using forms, registration materials, surveys, emails, and telephone inquiries which will identify the Personal Information which we are obtaining and how we plan to use such Personal Information. We often collect Personal Information from you and from third party service providers under circumstances in which we have obtained your consent to do so or as otherwise permitted by law.
Access to certain of InfoVista's webpages requires a login and password. The use of those webpages and the information or programs downloadable from those pages are governed by a written agreement between your employer as the licensee of the software and InfoVista. Your Personal Information may be retained by InfoVista to verify compliance with the agreement, log software licenses granted, track software downloaded from those pages, and track use of other applications available on the InfoVista Web site.

Usage of Personal Information
We will always identify the purposes for which we collect and use your Personal Information at the time we collect it, such as when you complete a registration form and we collect such information from you. When you receive such email notification, you will always have the option to unsubscribe to such notices in the future. You can withdraw consent at any time (unless withdrawing the consent would frustrate the performance of legal obligations) and upon providing us with thirty (30) days notice. However, the withdrawal of your consent may impact on our ability to serve you and to maintain our relationship. In any marketing communications sent to you, we will include any easily exercisable “opt out” function.
In certain circumstances, as permitted or required by law, we may collect, use or disclose Personal Information without your knowledge or consent. InfoVista does not, as a condition of supplying a product or service to you, require to consent to the collection, use or disclosure of Personal Information beyond that reasonably required to supply the product or service or for related operational or management or legal purposes, or to comply with its obligations under applicable law.

Utilization, Disclosure and Retention of Personal Information
We may keep a record of your Personal Information, correspondence or comments, in a file specific to you. We will utilize, disclose or retain your Personal Information for as long as necessary to fulfill the purposes for which it was collected and as permitted or required by law. We have established minimum and maximum retention periods and procedures for maintaining and destroying your Personal Information, but in any case will retain your Personal Information for at least one year to all you to have access to that information.

Response to Written Requests
We will make every reasonable effort to respond to each of your written requests not later than thirty (30) days after receipt of such requests. We will advise you in writing if we cannot meet your requests within this time limit. You have the right to make a complaint if we do not respond timely.
We will not charge you for access, modification and deletion of your personal Information. You may withdraw your requests for access to information by notifying us within the thirty (30) day notice period disclosed on the estimate.
